Court Blocks Proposed $100,000 H-1B Visa Fee

A federal judge has ruled against the proposed $100,000 fee for new H-1B visa applications, stating that the fee constituted a tax that had not been authorized by Congress. As a result, the fee cannot be implemented while legal challenges continue.

The decision comes as welcome news for employers and foreign professionals who rely on the H-1B program, preventing what would have been a substantial increase in hiring costs.

U.S. to Launch Premium Visa Interview Service

The U.S. State Department has announced plans to introduce a pilot program offering expedited visa interview appointments for certain tourist and business visa applicants.

Under the new initiative, eligible applicants will be able to pay an additional $750 fee to access faster interview slots at selected U.S. embassies and consulates. The program is expected to begin on 1 July 2026.

The service aims to help reduce long waiting times for travellers who require urgent visa appointments. However, applicants should note that the premium service only expedites the interview scheduling process and does not guarantee visa approval.

H-1B Holders Continue to Face Processing Challenges

Despite the positive developments, many H-1B visa holders continue to experience delays in visa renewals and processing.

Indian professionals, who represent a significant portion of H-1B visa recipients, are reporting longer processing times due to stricter renewal requirements. These measures include enhanced social media screening and, in some cases, mandatory visa renewals in their home country.

The ongoing delays continue to create uncertainty for both employees and employers, particularly in industries heavily dependent on international talent.
